Recently, Jade was featured by Today’s Wills and Probate in their article discussing ‘predatory marriage’. With the Law Commission’s acknowledgment of ‘predatory marriage’, which is to be considered in its upcoming supplementary consultation paper on wills, it’s a perfect time to learn more. Legally speaking, there is no definition, meaning it is far too easy to steal the Estate of an older person.
The article looks at the proposed reform of marriage laws from Predatory Marriage UK, whereby a Will is not automatically revoked following a marriage, meaning the risk for vulnerable people would be better safeguarded. Jade proposes an alternative to this in which there are more rigorous capacity tests for marriage. As of now, the capacity threshold for marriage is far below making a Will, and so an ill-willed opportunist could marry a victim that would not have the capacity to amend their Will, yet the Will would be changed because of the Will.
