Asking questions never hurt anyone. Millions of people engage with Solicitors every year, many of which have never delved into the world of Private Client law. It can be the case for some of us to assume that information is presented unprompted, and in this we would be mistaken. This may be because the answers seem obvious to someone dealing with matters every day, or to hide a weakness. Regardless of the reason, it can be highly beneficial to simply ask questions.

But which questions should you ask? Here are seven that may come in handy next time you’re choosing your Solicitor.

1. “Have you worked on matters like mine before?”

This is such a crucial question to ask your Solicitor. At the end of the day, experience matters most in achieving the best outcomes. A Solicitor familiar with cases like yours will understand nuances, potential challenges and effective strategies to resolve issues efficiently. Their expertise ensures you’re not paying for a learning curve, and they’re likely to anticipate complications, saving time and reducing stress. By confirming their relevant experience, you gain confidence that your Solicitor can handle matters professionally, providing tailored advice and solutions. It establishes trust and reassures you that your case is in capable hands. Of course, there are sometimes cases in which a less experienced Solicitor could do a better job, but this is still information that you may find helpful or encouraging.

    2. “Do you specialise in this area of law?”

This is essential. Ensuring that they have focused expertise in handling your specific legal issue is paramount. Specialists stay updated on the latest developments, laws and precedents in their field, offering in-depth knowledge and tailored advice. A Solicitor with a dedicated focus is more likely to navigate complexities, provide innovative solutions and achieve favourable outcomes. Generalists may lack the detailed insight required for intricate matters, leading to missed opportunities or delays. Confirming their specialisation/s gives you confidence in their ability to address your matter effectively and efficiently. This doesn’t mean that, if the answer to this question is “no”, they are unable to deal with your matter. A good Solicitor will be prepared to learn about any new updates, however it may create a delay.

      3. “Can you explain your fees clearly? Are there any hidden costs?”

If you want to avoid any unexpected financial surprises, this question is a must-ask. Transparency ensures you understand the cost structure, whether it’s hourly rates, fixed fees or additional expenses, such as court charges or disbursements. A Solicitor who can clearly outline costs demonstrates professionalism, integrity and respect for your budget. By clarifying whether there are any hidden charges upfront, you can plan effectively and maintain trust throughout your engagement. More cynically, if they are unable to effectively explain the reason for a cost or its pricing compared to other Solicitors’ fees, it may reflect negatively on that Solicitor’s practices. This question protects your interests, promotes accountability and ensures you receive value for the services provided.

        4. “How quickly do you respond to calls and emails?”

This is important in understanding your Solicitors approach to communication. Legal matters often require timely updates and swift decision-making, so a clear expectation of response times ensures you’re not left waiting for critical information. A Solicitor who prioritises prompt communication demonstrates professionalism reliability and respect for your concerns and time. This question also highlights their commitment to Client care and helps gauge how accessible they’ll be throughout the process. Knowling they will respond quickly provides peace of mind and builds confidence in their ability to manage your case effectively.

          5. “Will I be dealing with you directly, or will my matter be passed on to someone else?”

Knowing whether your Solicitor will personally be handling your matter ensures accountability and gives you confidence in their expertise. If your case is passed to a junior team member or another Solicitor, it’s crucial to understand their qualifications and how closely your original Solicitor will oversee their work. For the most part, if your matter is being handled by a different Solicitor, they will be perfectly capable of the work; after all, a Solicitor’s top priority should be Client satisfaction. However, this question helps set expectations for communication, consistency and quality of service, ensuring you receive the personalised attention your matter deserves.

            6. “Are you a member of any professional legal organisations?”

It can be extremely valuable to gain insight into your Solicitor’s professional standing and commitment to excellence. Membership in organisations such as the Law Society, STEP, the SRA or other specialist or regulatory bodies demonstrates adherence to high ethical standards and ongoing professional development. It indicates that your Solicitor stays informed about the latest legal practices and maintains a network of trusted peers for collaboration or referrals when needed. This question reassures you of their credibility, dedication to their field and ability to provide expert advice aligned with best practices in the profession.

              7. “Do you offer free initial consultations to discuss my matter?”

Last but not least, this is an excellent question to ask when exploring your legal options. A free consultation allows you to understand your Solicitor’s expertise, approach, and how they can help, without committing financially upfront. It’s an opportunity to ask questions, assess their suitability, and gain clarity on your next steps.
